By accessing or using Bracket Coder's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

These terms constitute a legally binding agreement between you and Bracket Coder. Please read them carefully before using our platform.

Bracket Coder provides software development services including but not limited to:

• Custom web and mobile application development
• SaaS platform architecture and development
• AI agent and automation solutions
• UI/UX design and frontend development
• Cloud infrastructure and DevOps consulting
• Ongoing maintenance and support

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

When creating an account with us, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these terms or remain inactive for an extended period.

All content, features, and functionality of the Bracket Coder website — including text, graphics, logos, icons, and software — are owned by Bracket Coder and protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission.

For client projects, the following terms apply:

• Ownership transfer — Upon full payment, all custom code and deliverables created specifically for the client are transferred to the client
• Pre-existing IP — Any pre-existing frameworks, libraries, or tools used in the project remain the property of Bracket Coder or their respective owners
• Timeline estimates — Project timelines are estimates and may vary based on scope changes, feedback cycles, and external dependencies
• Revisions — Each project includes a defined number of revision rounds as specified in the project agreement

• All fees are quoted in USD unless otherwise specified
• Payment schedules are defined in individual project agreements
• Late payments may incur a fee of 1.5% per month on the outstanding balance
• We accept payment via bank transfer, credit card, and major digital payment platforms
• Refunds are handled on a case-by-case basis as outlined in each project agreement

You agree not to:

• Use our services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the integrity of our services
• Upload malicious code or content
• Impersonate another person or entity
• Use automated systems to access our services without permission

To the fullest extent permitted by law, Bracket Coder shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability for any claim arising from these terms shall not exceed the total amount paid by you to Bracket Coder in the twelve (12) months preceding the claim.

Either party may terminate the service relationship with 30 days written notice. Upon termination:

• All outstanding payments become immediately due
• Completed deliverables will be transferred upon final payment
• Work in progress will be delivered in its current state
• Confidential information must be returned or destroyed

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising under these terms shall be resolved through binding arbitration in San Francisco, California.

We reserve the right to update these Terms of Service at any time. We will notify users of material changes via email or a prominent notice on our website. Continued use of our services after changes constitutes acceptance of the updated terms.
